1. Introduction

Welcome to LoveTracker! These Terms of Use (the "Terms") govern your access to and use of the mobile applications, websites, and services (the "Services") provided by LoveTracker. By accessing or using the Services, you agree to comply with these Terms and our Privacy Policy. If you do not agree with these Terms, please do not use our Services.

We may update these Terms from time to time, and any changes will be effective upon posting the revised version. It is your responsibility to review these Terms periodically to stay informed of any updates.

2. License Grant

LoveTracker grants you a limited, non-exclusive, non-transferable license to access and use the Services for personal, non-commercial use, subject to these Terms. You may not reverse-engineer, decompile, disassemble, or otherwise attempt to derive the source code of the Services.

Any commercial use of the Services, including reselling or redistributing content, is prohibited unless explicitly authorized by LoveTracker.

3. Account Creation and Security

To access certain features of the Services, you must create an account. When creating an account, you will provide certain personal information (such as email address). You are responsible for maintaining the confidentiality of your login credentials (username, password, etc.) and for all activities that occur under your account.

• Account Security: You agree to notify us immediately if you suspect any unauthorized access to your account or any breach of security. We are not responsible for any losses or damages resulting from your failure to maintain the confidentiality of your login information.
• Account Information: You must ensure that the information provided during the account creation process is accurate and up to date. If there are any changes to your information, you must promptly update your account details.

4. Service Features and Your Responsibilities

LoveTracker includes features that may involve location sharing, friend connections, system notifications, and optional information processing. You agree to use these features responsibly and in compliance with applicable laws and these Terms.

4.1 Friend Connections via Invitation Codes

LoveTracker may allow you to add or invite friends through invitation codes. You are responsible for safeguarding invitation codes you generate and for ensuring you only share them with intended recipients.

• You may not use invitation codes to harass, spam, or attempt unauthorized access to other users’ accounts.
• We may limit, invalidate, or expire invitation codes to protect users and prevent abuse.

4.2 Location Sharing and Location-Based Alerts

Certain features allow you to share your location with approved friends and receive related alerts (e.g., friend starts/stops sharing location, friend status changes, or friend leaving reminders). Location sharing occurs only when enabled by the user within the app and subject to device permission settings.

4.3 System Notifications and One-Click Predefined Messages

LoveTracker may provide system notifications and one-click predefined messages that you can send to selected friends. These are system-generated notifications based on your actions and do not constitute an instant messaging service.

• You agree not to use notifications to harass, threaten, or spam others.
• Delivery of notifications may be affected by device settings, operating system restrictions, network conditions, or third-party push notification services.

4.4 Map Screenshot Feature and Sharing

The Services may include a screenshot feature that generates a map image containing your location and the locations of approved friends who are currently sharing. Screenshots are generated only when you actively tap the screenshot button.

• If you share a screenshot outside the app (e.g., via social media, messaging apps, or other third-party platforms), LoveTracker cannot control how that content is used, stored, or redistributed.
• You are responsible for ensuring you have appropriate permission and consent before sharing screenshots that may include other users’ location information.

4.5 Optional Number-Based Information Feature

The Services may include an optional flow that processes limited number-based information entered by you to provide general reference information and support app functionality. This feature does not provide real-time tracking and cannot be used to determine any individual’s precise location.

5. Prohibited Conduct

You agree not to engage in any of the following activities:

• Using the Services for illegal, harmful, abusive, or fraudulent purposes.
• Using the Services to monitor, track, or stalk any person without their explicit knowledge and consent, or otherwise violating privacy laws.
• Posting or sharing content that violates intellectual property rights or privacy laws.
• Distributing malware, viruses, or engaging in activities that compromise the security of the Services.
• Attempting to gain unauthorized access to any part of the Services or other accounts, networks, or systems connected to the Services.
• Misusing invitation codes, notifications, or screenshots to harass, threaten, or spam others.

6. Subscriptions and Payments

Some features of the Services are available through a paid subscription. By subscribing to our premium services, you agree to the following terms:

• Subscription Fees: Subscription payments are processed through your Apple ID via the Apple App Store. Payments are charged to your account at the time of purchase.
• Automatic Renewal: Your subscription will automatically renew unless you cancel it at least 24 hours before the renewal date. You can manage or cancel your subscription in the "Manage Subscriptions" section of your Apple ID settings.
• Trial Period: Some subscriptions may include a low-price trial period. If you do not cancel before the trial ends, your subscription will renew at the full price.
• Refunds: For refund inquiries, please refer to Apple's official refund policy on the App Store.

7. Termination

We reserve the right to terminate or suspend your account or access to the Services at any time, without notice, for any breach of these Terms. Upon termination, you must cease all use of the Services, and any licenses granted to you under these Terms will immediately terminate.

• Suspension: We may suspend your access to the Services if we suspect fraudulent activity or violation of these Terms.
• Account Deletion: You can delete your account at any time via the settings section in the app or by contacting us at lovetracker-ios@outlook.com.

8. Disclaimer of Warranties

The Services are provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied. We do not guarantee that the Services will be uninterrupted or error-free, or that any errors will be corrected. We disclaim all warranties, including but not limited to:

• Warranties of merchantability, fitness for a particular purpose, and non-infringement of third-party rights.
• Warranties that the Services will be compatible with any other services or systems.

We do not guarantee the accuracy or reliability of location data, and we are not responsible for any damages resulting from GPS errors, device settings, third-party platform limitations, or data transmission failures.

9. Limitation of Liability

In no event shall LoveTracker or its affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill arising from your use of or inability to use the Services. Our total liability to you for any claims arising from the use of the Services shall not exceed the total amount you paid to us for the Services in the 12 months preceding the claim.

10. Data Protection and Privacy

We take your privacy seriously and handle your personal data in accordance with our Privacy Policy. Please review our Privacy Policy for more information on how we collect, use, and protect your personal information.

11. User Guarantees

By using the Services, you guarantee that:

• You will not use the Services to infringe the intellectual property rights of others.
• You will not engage in fraudulent activities or distribute unlawful content.
• You will not collect, process, or distribute personal data without proper consent.
• You also guarantee that any content you post or share does not violate any third-party rights.

12. Changes to Terms

We reserve the right to modify or update these Terms at any time. If any significant changes are made, we will notify you through the app or other means. Your continued use of the Services after the update constitutes your acceptance of the revised Terms.
